1. Introduction

This website is provided by Video Management. By accessing this website you are agreeing to these Terms of Use. If you do not agree with any of the Terms of Use below, do not use this website. Video Management reserves the right to modify these Terms of Use at any time. Such modifications shall be effective immediately upon posting of the modified Terms of Use. By using this service after we have posted notice of such modifications you agree to be bound by the revised Terms.

2. Copyright and trade marks

All material on this website is protected by copyright, trade marks and other intellectual property rights, all of which are owned and controlled by Video Management and its licensors. You may view, download and print (but not photocopy) the material for your own personal and non-commercial use only. You may not distribute, transmit, reproduce or publish by electronic or any other means any part of the data without the prior written permission of Video Management.

Video Management is a brand owned by Executive Learning Partnership.

3. Limitation of Liability and Disclaimer

Whilst Video Management endeavours to ensure that the information on this website is correct, it is provided on an 'as is' basis without warranties of any kind and, to the maximum extent permitted by law, Video Management disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.
Video Management does not warrant that the functions contained in the materials on this website will be uninterrupted or error-free, that defects will be corrected, or that Video Management or the server(s) that makes this website available are free of viruses or other harmful components.
You explicitly agree that use of this website is at your sole risk. You (and not Video Management) assume the entire cost of all necessary servicing, repair or correction. You expressly agree that neither Video Management nor any person or entity involved in the creation, production or distribution of this website are responsible or liable to any person or entity whatsoever for any losses or damages of any nature (including, but not limited to, loss of profits, loss of data, direct, indirect, special or consequential damages) based upon or resulting from a third party's use of or inability to use this website, except to the extent that Video Management or any other relevant entity or person are required by law to accept such liability.

Video Management accepts no responsibility for the content on any site to which a hypertext link from this site exists. The links are provided 'as is' with no warranty, express or implied, for the information provided within them.

5. Payment

This website provides users with a free information service, but should Video Management add services for which payment is required, users will be notified within the site and given instructions for subscribing to any such services.

6. Choice of Law and Jurisdiction

These Terms of Use shall be governed by, and construed in accordance with, the laws of Belgium. The parties irrevocably agree that the courts of Belgium shall (subject to the paragraph below) have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these Terms or the legal relationship established by them, and for those purposes irrevocably submit all disputes to the jurisdiction of the Belgian courts.
For the exclusive benefit of Video Management, Video Management shall retain the right to bring proceedings as to the substance of the matter in the courts of the country of your residence or, where these Terms are entered into in the course of your trade or profession, the country of your principal place of business.

7. Video Management

Video Management is a brand owned by Executive Learning Partnership, registered in Belgium under number BE 0475.802.321, whose registered office is at Naamsesteenweg 334, BE-3001 Leuven, Belgium.

SALES CONDITIONS

1. Copyright

The buyer can only use the programme and ancillary materials within his organisation and for his personnel. It is prohibited to either copy, sell, rent or give the purchased programmes or the ancillary materials for usage by or for third parties.
Every infringement on this – besides copyright legislation – leads to a breach of the contract. Should the occasion arise, the seller is entitled to damages equalling the licence price of all existing language versions of the programme in question, unless he can prove greater damage.
Of every Video Management video programme the internal licence per language version can be purchased for ten times the price of an individual programme. The seller maintains copyright and all other intellectual rights.

2. Price

The prices mentioned in catalogues, brochures and other promotional material are only guidelines. The price stated on the invoice should be regarded as the sales price. Shipment costs are not included in the sales price.

3. Payment

The invoice is payable within thirty days after the invoice date, unless if mentioned otherwise on the invoice or order form.
In case of non-payment of the invoice within the specified time period, 1,5% interest per month will be legally charged on the invoice amount starting the day after the term of payment mentioned above.
To cover recovery costs a fixed penalty equalling 15% of the invoice amount, with a minimum of € 75, - and a maximum of € 2.500, - will be charged, besides demur interests and possible legal costs. The penalty does not detract from all other rights or damages to the credit of the seller.

4. Competent Court

In case of recovery or dispute, only the Brussels courts are competent.
